With a small office and reduced work force of 10 employees we managed to identify the need for the rich and famous to keep up with their lifestyle and purchase large custom homes. The custom home business is a specialty field it is not just a big box it is a lifestyle. Mr. Bercovicz developed a questioner for the potential buyers to better understand their lifestyle and habits in order to design / build a suitable house. Mr. Bercovicz recognized the opportunity and created a DBA of Creative Builders Corp named The Construction Consultant.
As a consultant we have provided our services to Plaintiff’ claims against Insurance Companies on very difficult cases that could not settle, and were on the way to litigation. Our approach was very simple and thorough “Simplify and Document” the case for presentation. In most cases the dispute was resolved out of court due to clear and convincing evidence presented by The Construction Consultant

Some of my expert witness cases
Slip and fall case Boca Raton Florida
I was hired by a major personal injury law firm in Boca Raton Florida to provide expert witness services for a client that fell and broke the knee at a local restaurant.
I inspected and documented the contact surface area of the subject accident with: co-friction analysis of the surface, material composition and slippery test.
Upon presenting the insurance Company for the restaurant with my documentation, the case came to a successful conclusion and the attorneys obtain a very good settlement for the client.
Storm damage to a local hotel in Fort Lauderdale Florida
I was hired by the property owner to help documenting the property damages and negotiating with insurance. The insurance adjuster’s position was that the roof failed due to old age deterioration.
After my involvement in the case I first inspected the building, prepared a report and subsequently testified that the edge of the roof on the NE comer of the building lifted and failed due to a intense wind gust causing a larger portion of the roof to fail and flood the interior portion of the building. My testimony was supported by local radar reports showing the weather at the time of the occurrence, wind uplift calculation and a small building model was made for the court presentation.
The client in this case was awarded 100% of the claim.
Single family residence Fort Lauderdale Florida
I was hired by a major personal injury law firm in Plantation Florida to provide expert witness services and document a property damage claim for an out of Town homeowner that had a water leak from the rear of the refrigerator water line, flooding a major portion of the house. The insurance Company inspected the property and offered a settlement to restore the affected areas around the refrigerator. I have inspected the subject property and after careful analysis presented my findings to the insurance Co. The insurance Co. did not agree with my findings and a mediation was set. At the mediation I presented the following additional facts in connection with the claim, code compliance requiring the restoration to include upgrades not related to the flood, additional living expenses for the property owners during restoration time and other indirect related expenses. The conclusion of the mediation was a settlement that awarded the client 6 times the amount of the original insurance Co estimate.
Storm Damage to a major Hotel St. Thomas USVI
I was hired by the property owner to help documenting the property damages and negotiating with insurance. The insurance Co. position was that the exterior doors and windows with east exposure to the open ocean were not maintained properly and failed due to poor maintenance.
After my involvement in the case I first inspected the building, prepared a report and subsequently testified that the exterior wall facing the ocean with all related components did not fail and is in good condition after the storm. My investigation revealed that the structural damage from the storm originated at the front lobby canopy and compromised a major portion of the front structure. My testimony was supported by local radar reports showing the weather at the time of the occurrence, wind uplift calculation for the front canopy and the common structure elements connecting the canopy to the building.
The client in this case was awarded 95% of the claim.
